Definitions

The following words and phrases used in these terms and conditions mean - Accommodation; the property specified in a Booking Request. Accommodation Fees; the amount payable by you for the Accommodation during a Reservation. Booking Request; your request to stay at the Accommodation made via the Website or over the phone. This House Limited, This House, we, our or us; This House Limited, company incorporated under the laws of England and Wales registered at Springfield House, Littleworth, Amberley, Stroud GL5 5AG. Charges; the charges (in addition to the Accommodation Fees) payable by you in relation to a Reservation. Reservation; the period for which the Accommodation is made available to you and your party as set out in the Booking Request and confirmed in writing by us. Unavoidable Event; an event of force majeure outside a party’s reasonable control, which shall include but not be limited to any act, or omission of the other party, strikes, lock outs, industrial action by third parties, civil commotion, riot, terrorist attack or threat of terrorist attack, invasion, war, fire, explosion, storm, flood, earthquake, subsidence, drought, epidemic or other natural disaster, or failure of public or private telecommunications networks, power networks or water supplies, local building or road works, transport interruptions delays or cancellations. When used in these Terms and Conditions, the term ‘written’ or ‘in writing’ shall include email, unless we specify otherwise.

Terms of this agreement

These Terms and Conditions apply to any Booking Request and all Reservations made by you. You confirm that you are over the age of 25. This House Limited takes great care to ensure all listings of accommodation on the website are accurate and up to date but shall not be responsible for any changes or minor differences. This House Limited accepts no responsibility for any changes or closures to local area amenities or attractions mentioned on the Website or advertised elsewhere.

Booking process

A Reservation shall be binding, a contract formed on these Terms and Conditions between you and This House Limited, when a Booking Request is accepted by us and confirmed in writing.

For the avoidance of doubt, any email confirming receipt of a Booking Request, whether sent by us or any service provider on our behalf, shall not be an acceptance of a Booking Request. This House retains the right not to accept any Booking Request. In such a situation, This House shall notify you in writing and refund in full any Accommodation Fees or Charges you have paid.

No Reservation confirmed in writing may be changed without our prior consent, so please check the details of the confirmation and notify us immediately if anything is not correct.

Payment

The Accommodation Fees and Charges payable by you shall be as set out in the Booking Request or as otherwise notified by us on confirmation of your booking.

A non-refundable deposit of 30% of your Total Charge is payable upon Reserving your stay. Any outstanding Charges shall be due no later than 8 weeks before the start of the Reservation. If the Booking Request is made less than 8 weeks prior to the start of the Reservation, the full amount will be due upon Reservation. By paying such amounts you accept these Terms and Conditions.

If any payment is late, we reserve the right to cancel the Reservation and retain any deposit paid. 

Cancellations and Refunds

This House Limited shall not be responsible for any failure to perform, or delay in performance, of any or all obligations caused by an Unavoidable Event and shall notify you as soon as reasonably possible of any such Unavoidable Event.

This House Limited may cancel your Reservation if there is an Unavoidable Event which affects the availability or suitability of the Accommodation. In such circumstances, This House will offer you a full refund. If any cancellation due to an unavoidable event occurs during a Reservation, This House shall offer you a partial refund for the cancelled part of the Reservation 

You may cancel the Reservation at any time, but the following conditions apply: the 25% deposit is non-refundable.

If a cancellation is within 8 weeks of the rental start date the full booking value will be forfeited, unless the Accommodation is re-let for the same period and for the same cost. If the Accommodation is re-let you will receive a refund of the rental paid less the 25% deposit.

Damage and accidents

If you find damage or missing items on your arrival, please notify us immediately so we do not charge you for these later. We will notify you of any damage to the Accommodation or any items missing and of the amount we will charge to cover the cost of repairing the damage or replacing the items. 

This House Limited shall have no liability to you for: (i) the death or personal injury to you or anyone in your party, or (ii) for any loss or damage to your personal property, in each case except as may not be permitted or limited by law.

Our rights of access

Our staff or contractors may need to access the Property if there is an unforeseen problem, to investigate a complaint you have made, or to perform certain routine property checks. If this happens, we will do our best to let you know in advance of the date and time that we will need access. If we do need to access the Property for any reason we will always try to access at reasonably convenient times (other than in the event of an emergency).

Termination

This House Limited may terminate this Agreement with you and any Reservation if you fail to pay any sums when due or are in material breach of the Terms.

You may only terminate this Agreement if This House: breaches this contract in any material way; goes into liquidation or has a receiver or an administrator is appointed over its assets; is affected by an Unavoidable Event.

Limitations and exclusions of liability

Nothing in this Agreement shall limit either party’s liability to the other for fraud or fraudulent misrepresentation, death or personal injury caused by their negligence, or for any other liability that may not be excluded or limited by law.

This House Limited shall not be liable for any loss or damage caused to any items, belongings or vehicles of the Guest. It is your responsibility to obtain suitable insurance to cover any such losses.

Personal data

To provide the Accommodation we collect personal data about you and members of your party. We shall collect and use such personal data in accordance with our privacy policy, as set out on the Website from time to time.

Cottage Rules 

Upon entering into an agreement with This House Limited. You agree to follow the Cottage Rules as set out on https://www.thishouse.uk/house-rules

Any failure to comply with the Cottage Rules during your stay will result in termination of this agreement and you will be asked to leave the property with no refund applicable.

Governing Law and Jurisdiction

This Agreement shall be governed by the laws of England and Wales and the parties submit to the non-exclusive jurisdiction of the English courts. Nothing in these Terms and Conditions affects your statutory rights.
